The Liquor Authority held criminal hearings and find the licensee guilty in his absents. They call it according to the agendas as Prosecuter hearings.
The Tribunal is littery hearing evidence from the prosecutor in the absence of the Licensee. Which is totally illegal. “ex parte” (done with respect to or in the interests of one side only or of an interested outside party.)
Example: “The owners made an ex parte application to the High Court for a stay on the decision” and “in absentia” (in the absence of the person involved ( Licence Holder): Example – “He was sentenced in absentia by the court.
Section 82 of the Western Cape Liquor Act only allows the Tribunal or Presiding officer to issue a fine or cancel your licence if you did not comply with an order from the Tribunal.
The powers of the Presiding officer are to call for a meeting of the Tribunal, not for a criminal hearing for a criminal offense. They are not a criminal court. But they keep on doing this illegal act in “Ultra Virus” (beyond the powers). Section 82 clearly states that the presiding officer or tribunal may not Prosecute, and if they want the licensee to be prosecuted, they must refer the matter to the South African Police.
This is due to the Minister of Safety and Security forcing them to show statistics for his political agenda. The Liquor Authority is supposed to fall under Trade and Industry ad, not Safety and Security.
The existence of a prosecutor at the liquor Authority does not exist. It is not in the Act.
This has had a major impact on the economy, and again this is due to the “Poor Law educational System since 1998.
The Liquor Authority has no idea of the legal principles of Administrative Law
